2. This application has been filed for modification of the order dated 26.05.2025 wherein the petitioner was granted bail however it has been submitted that the conditions imposed in the bail granted by the aforesaid order as far as condition no. 8(ii) and 8(iii) are concerned, that would adversely affect the petitioner as he is posted in Gwalior and is in a Government Service posted as Sipoy in the 3rd Battalion of Bihar Regiment, Danapur.

3. It has been submitted by the learned counsel for the petitioner that if these two conditions are relaxed then the

Patna High Court CR. MISC. No.87833 of 2025(2) dt.19-12-2025 2/2 petitioner shall not be compelled to appear on each and every date before the court below.

4. As far as condition no. 8(ii) is concerned, there is a rider that the petitioner will remain present on each and every date provided the learned trial court requires the same in that case the liberty is with the learned trial court to seek appearance of the petitioner, if so required.

5. As far as condition no. 8(iii) is concerned, the absence on two consecutive dates would make the bail bond of the petitioner liable to be cancelled and therefore it stands deleted. However, an application with regard to the nonappearance of the petitioner shall be filed by the learned counsel appearing on behalf of the petitioner before the learned trial court citing specific reasons and the same shall be considered looking at the fact that the petitioner is in the service of the armed forces.
