JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 16.10.2019, seeks bail in connection with Riga P.S. Case No. 282 of 2019 dated 15.10.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that 3324.960 litres of liquor was found kept in a truck. The aforesaid consignment was being unloaded by some of the loaders including the petitioner, who on seeing the police party could effect their escape.

The petitioner is said to have been arrested while fleeing away.

The learned advocate for the petitioner has submitted that it is a case of mistaken identity. The cases in which the petitioner has earlier been made

Patna High Court CR. MISC. No.78865 of 2019(4) dt.17-03-2020 2/2 accused, he has been granted bail.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Sitamarhi in connection with Riga P.S. Case No. 282 of 2019.
