1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial no. 995 of 2023 (arising out of Naubatpur P.S. Case no.341 of 2023) registered under sections 402, 399 and 414 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, the informant states that on receiving secret information that the accused persons had gathered in the house of one Niranjan Ram and were planning to give effect to an occurrence, it is stated that a raid was conducted. From the possession of the petitioner a loaded country made pistol besides other articles were recovered.

Patna High Court CR. MISC. No.4931 of 2024(2) dt.07-02-2024 2/2 petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 21.5.2023 and has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., no incriminating article having been recovered from his possession, his being in custody since 21.5.2023 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no. 995 of 2023 (arising out of Naubatpur P.S. Case no.341 of 2023) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd , Danapur, District- Patna.
