1. The writ petition is filed for the following reliefs:- A. A Certiorari for quashing and setting aside the order passed by the Sub-Divisional Officer, Kahalgaun vide Memo No. - 497 dated 22.09.2018 whereby and whereunder licence of the petitioner's PACS Fair Price Shop bearing No. 12/16 has been cancelled with immediate effect contained in Annexure - 1.
B. A mandamus commanding the Respondents to restore the
Patna High Court CWJC No.20132 of 2018 dt.31-07-2025 2/3 petitioner's licence as before and to make allotment for the petitioner's shop.
C. Any other relief or reliefs for which petitioner may be found entitled in the fact and circumstances of the present case may be granted to him."
2. The Learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file an appeal against cancellation of license of the Fair Price Shop bearing No. -12/16 before the appropriate authority.
3. Permission is granted. The petitioner is directed to file an appeal within one month from the date of receipt of this order before the appropriate authority. In turn, the appropriate authority shall dispose of the appeal within three months from the date of filing of the same.
4. It is needless to mention that before passing any order, all the concerned parties shall be put on notice and given an opportunity of hearing. Any order passed shall be communicated to the party.
5. With the above observations, the present writ petition stands disposed off.
