JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 353, 435, 427 of the Indian Penal Code, 27 of the Arms Act, 3⁄4 of E.S. Act and 17 of C.L.A. Act.

Petitioner is not named in the first information report and it appears that in course of investigation, the name of petitioner surfaced in this case. Petitioner does have criminal antecedent of seven cases but in the present case, he is in jail custody since 10.07.2018 and having more or less similar allegation, some co-accused have already been admitted to bail by different Benches of this court.

No.77207 of 2019(2) dt.18-12-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Aurangabad (Bihar) in connection with Sessions Trial No. 493 of 2018/390 of 2018 arising out of Madanpur P.S. Case No. 138 of 2014.
