The petitioner apprehends his arrest in connection with Galgaliya P.S. Case No. 38 of 2017, registered under Sections 379, 411 and 413/34 of the Indian Penal Code. The accusation is that in course of patrolling duty, one vehicle was intercepted. In that course, one person stated to flee away but on chased, he was apprehended, who disclosed his name as Sabul Gosh. On search, 15 bundles of High Tension electric wire were seized from the vehicle. Sabul Gosh also disclosed the name of Najruddinj on whose instruction, High Tension electric wire were loaded on the vehicle. Learned counsel for the petitioner submits that, in

No.68593 of 2018(3) dt.18-06-2019 2/2 fact, petitioner is the owner of 407 pick-up van bearing Registration No. WB 69A 4552, in which, High Tension electric wire were loaded by driver, Sabul Gosh and petitioner being the owner of the aforesaid vehicle has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Kishanganj, in connection with Galgaliya P.S. Case No. 38 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
