====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-12-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 341, 323, 324, 504/34, 307 and 302 of the Indian Penal Code.

The offence under Section 302 of the Indian Penal Code was added later on. There is general and omnibus allegation against the petitioner of commission of assault, rather specific allegation is against co-accused Kanhaiya Sahani to cause injury at the head of the deceased. Co-accused Banai Sahni has already been allowed bail by a Coordinate Bench of this Court vide order dated 20.05.2019 passed in Cr. Misc. No. 14079 of 2019 (Annexure-2).

No.78918 of 2019(2) dt.04-12-2019 2/2 Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chhatauni Police Station Case No. 14 of 2013, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
