ANJANA MISHRA ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the husband, is in custody since 31.07.2017, in connection with S. Tr. No.88 of 2018 arising out of Bhagwanpur P.S. Case No.181 of 2015 registered for the offence under Sections 304B, 201 and 34 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide Annexure 1 and in view of the fact that certain witnesses have turned hostile, the petitioner seeks to renew his prayer for bail.

A report had been called for from the court of Additional District & Sessions Judge-I, Vaishali at Hajipur,

Patna High Court Cr.Misc. No.68114 of 2018(3) dt.06-02-2019 2/2 who has since reported that eight, out of 17 witnesses have already been examined and the next date fixed for further evidence is 01.02.2019.

In view of the fact that trial has advanced substantially, let the aforementioned trial proceed on day to day basis so as to conclude positively by the 30th of May, 2019.

The application stands disposed of.
