JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Sour Bazar P.S. Case No. 39/2018, registered for offences punishable under Sections 304(B), 120(B), 201 of the Indian Penal Code.

Allegation against the petitioner is of dowry death and he happens to be the husband of deceased.

Submission of learned counsel for the petitioner is that after investigation the police has submitted charge-sheet under Section 306 of the Indian Penal Code against the petitioner. During investigation it has come that she has taken pesticide and apart from that there is no specific allegation against the petitioner and he is in custody since 29.05.2018. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.64311 of 2018(3) dt.20-11-2018 2/2 circumstances of the case, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 39/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
