2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Begusarai Town P.S. Case No. 445 of 2024 and G.R. No. 1110/2024 instituted for the offence under Sections 281 and 106(1) of Bharatiya Nyaya Sanhita, 2023 and Section 37(c) of Bihar Prohibition and Excise Act and Sections 125(A), 125(B), 105 Part 011, 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 184, 185 and 186 of Motor Vehicle Act.

3. The case of the prosecution is that the informant and his brother was going on a scooty and from opposite direction one Alto car dashed them. The car was being driven

Patna High Court CR. MISC. No.88030 of 2024(2) dt.10-01-2025 2/3 rashly and in that accident, the younger brother of the informant namely, Md. Jabir Hussain who was plying the vehicle, died on spot.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the FIR was lodged against unknown persons. The name of this petitioner has surfaced during investigation. The petitioner has got nothing with the alleged car rather he was only a passenger in that car. In any view of matter, it is only a case of rash driving. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. In contra, learned APP appearing for the State opposes the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Begusarai Town P.S. Case No. 445 of 2024, he will be enlarged on bail on furnishing bail bond of Rs.
