JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 The allegation against the petitioner is of cruelty with respect to demand of dowry and ousting the complainant out of the house. It appears that O.P.no.2 has appeared through a Lawyer and the matter was sent to the Patna High Court Mediation Centre and now the mediation report is available at flag 'B' and that shows that in spite of granting time to the O.P.no2 for three times, she did not choose to appear before the learned court below.
Submission of the learned counsel for the petitioner is that he is still ready to keep her but in spite of that it is the O.P.no.2 who has not appeared before the Mediation Committee and there is no specific allegation attributed against the
Patna High Court CR. MISC. No.65807 of 2018(5) dt.09-04-2019 2/2 petitioner.
Heard learned counsel for the complainant, who could not also satisfy the Court as to why she could not appear in spite of the matter being sent to the Mediation Centre. In such view of the matter, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Complaint Case No.509C/2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
