2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25 (1-b)a, 26 and 35 of the Arms Act.
3. The case of the prosecution is that from the possession of co-accused, namely Vijay Kumar @ Vijay Sao one countrymade pistol and three live cartridges were recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. Nothing has been recovered from the possession of the petitioner. It is further submitted that name of the petitioner has surfaced on the confessional
Patna High Court CR. MISC. No.88109 of 2024(4) dt.08-04-2025 2/2 statement of co-accused, namely, Vijay Kumar @ Vijay Sao. Further submission is that the said co-accused, Vijay Kumar @ Vijay Sao, from whom the recovery is made, has been granted bail vide order dated 28.02.2023 passed in Cr. Misc. No. 63253 of 2022 by a co-ordinate Bench of this Court. The case of the petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 20.10.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Goh P.S. Case No. 242 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad.
