Petitioner seeks bail in a case registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
Six persons are named in the FIR. The petitioner and co-accused Raja Kumar Paswan are not named in the FIR. Name of the petitioner surfaced in the confessional statement of co-accused Raja Kumar Paswan, who has already been allowed bail by a Coordinate Bench of this Court vide order dated 22.09.2017 passed in Cr. Misc. No. 46410 of 2017 (Annexure2). Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.78820 of 2019(2) dt.04-12-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Session Case No. 552/2018 arising out of Mojahidpur Police Station Case No. 152 of 2015, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
