2. The petitioner is apprehending his arrest in Bodh Gaya P.S. Case No. 62 of 2023 registered under Sections 341, 323, 498(A), 504, 506, 379, 494/34 of the Indian Penal Code and 3⁄4 of D.P. Act.

Allegedly, the marriage of the informant was solemnized with the petitioner in the year, 2017 and after marriage, the petitioner along with others is said to have tortured and assaulted the informant for non-fulfillment of demand of dowry and ultimately, she was ousted from her matrimonial house.

4. It has been submitted on behalf of the parties, that the petitioner and the opposite party No. 2 have compromised the case before the Mediation and Conciliation Centre. The terms and

Patna High Court CR. MISC. No.86862 of 2024(4) dt.15-10-2025 2/2 conditions of the compromise is annexed with the report of learned Mediator. According to terms and conditions, the petitioner has to pay Rs. 3,00,000/- to opposite party No. 2 and she will withdraw the case. It is also agreed upon that with consent, the petitioner and the opposite party No. 2 will file a case for decree of divorce under Section 13(B) of Hindu Marriage Act, 1955.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Gaya in connection with Bodh Gaya P.S. Case No. 62 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of BNSS, 2023.

6. If either of the parties retracts from the terms and conditions of the compromise, the learned court below shall pass appropriate orders.
