The petitioner, it is stated, has been student of M.A. (English) in Patna University. She is seeking direction to the respondent Patna University to allow her to re-appear in Continuous Internal Assessment (CIS) for all the four semesters of M.A. (English) course and revise her result accordingly. The stand of the petitioner is peculiar. It is her case that in order to pass post graduate examination, a candidate has to secure pass marks in CIA, which is 50% of the total marks of that subject. She contends that she has secured less than 50% marks, yet she has been declared pass in M.A. (English) with second division. In order to improve her performance, she has
Patna High Court CWJC No.20887 of 2018(2) dt.30-10-2018 2/3 applied before the Head of Department of English of the University and the Vice-Chancellor of the University also requesting them to allow her to appear for CIA in terms of Regulation 3.1 read with 5.3 (vii) and 5.3 (viii). Since it is the case of the petitioner that she had approached the Head of Department of English of the University and the Vice-Chancellor of the University in 2017 itself but no decision has yet been taken, I direct that let the Controller of Examination of the University give the petitioner personal hearing on 31.10.2018 at 11 A.M. The Controller of Examination of the University shall be obliged to give her personal hearing, if she appears before him at 11 A.M. tomorrow, i.e. on 31.10.2018, with a copy of this order and her representation made before the Head of Department of English of the University.
This order is being passed in view of the stand, which has been taken that 5th November, 2018, is the date fixed for examination.
This application stands disposed of accordingly. This order has been passed in the presence of the learned counsel for the University and accordingly this Court expects that he shall inform the Controller of Examination of the
Patna High Court CWJC No.20887 of 2018(2) dt.30-10-2018 3/3 University about this order.
