JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-02-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The grievance of the petitioner in the present writ application relates to payment of arrears of salary on accunt of 7th Pay Revision as well as M.A.C.P.

Referring to Annexure-2, learned counsel for the petitioner submits that relevant documents with regard to difference of arrears have already been submitted to the respondents but till date no decision has been taken. Considering the aforesaid, the writ application is

Patna High Court CWJC No.24417 of 2019(2) dt.13-02-2020 2/2 disposed of with a direction to the respondents to take appropriate decision with regard to the claim of the petitioner for payment of difference of salary and arrears thereof in terms of 7th Pay Revision and for grant of M.A.C.P at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order.

The respondents are not only under obligation to ensure the disposal of the representation but also to ensure payment of consequential benefits to the petitioner within period as indicated above.

The respondents cannot adopt pick and choose policy in making payment of arrears of salary and interest, if any. (Anil Kumar Upadhyay, J) BT/- U
