JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-07-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in Shikarpur P.S. Case No. 386/2018, instituted for offence under Sections 302, 120(B) and 201 of the Indian Penal Code.
3. It is alleged in the written report that on 07.10.2018 son of informant had gone to field for watching an unknown person who had called him by phone near Pipal tree but the son of informant did not return. It is alleged that on 11.10.2018, dead body of son of informant was recovered. The informant raised suspicion that all the accused persons, named in the F.I.R., have committed murder of her son due to old enmity.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, informant is not eye-witness to the occurrence
Patna High Court CR. MISC. No.88226 of 2024(4) dt.18-07-2025 2/2 and only suspicion has been raised. Petitioner is in custody since 20.09.2024. Similarly situated co-accused persons have already been granted bail by this Court, vide orders annexed at Annexure - 2 to the bail petition.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 386 of 2018.
