1. Heard the parties.
2. Petitioner seeks regular bail in connection with Neemchak Bathani P.S. Case No. 175 of 2023 dated 23.09.2023 registered under Section 341, 323, 504, 506, 307 of the I.P.C. and Section 27 of the Arms Act.
3. This is second attempt for regular bail inasmuch as on the previous occasion the prayer for grant of bail of the petitioner was rejected on 09.08.2024 vide Cr. Misc. No. 45968 of 2024 with observation that the petitioner may renew his prayer for bail after six months of custody if the trial does not show progress.
4. As per the first information report the informant is the owner of a piece of land which was forcibly grabbed by the

On 22.09.2023 when the informant went upon the land and asked the petitioner to stop construction upon the subject land, in the meanwhile, the petitioner brought country made pistol from his grocery shop and fired upon the informant due to which he sustained firearm injury on little finger of his left hand.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.05.2024 and has falsely been implicated in this case on the basis of the allegation that the petitioner has grabbed the land of the informant but the fact of the matter is that the petitioner is the purchaser of the subject land from one Kanti Devi who is the cousin sister-in-law of the informant's grandmother. He further submits that the injury caused to the informant is simple in nature i.e. lacerated wound as per the opinion of the doctor.
6. On the other hand, learned counsel for the informant vehemently opposed the prayer for bail and submits that the petitioner is having criminal antecedents and is a land grabber. Four cases of serious nature of offence have been lodged against the petitioner. The petitioner with muscle power has grabbed the land of the informant and has started constructing house upon it. The petitioner fired upon the informant from an unlicensed

Regard being had to the submissions made by the parties, taking into consideration the period of custody, the fact that this is second attempt for regular bail on behalf of the petitioner and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, I am inclined to grant regular bail to the petitioner.
8. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000 /- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Gaya in connection with Neemchak Bathani P.S. Case No. 175 of 2023.
