2. Petitioner seeks regular bail in connection with K. Nagar (Champanagar) P.S. Case No. 81/ 2022 dated 15.02.2022 registered for the offence(s) punishable under Section(s) 147, 148, 149, 341, 323, 324, 325, 307, 302, 504 and 506 of the IPC.
3. The main submissions advanced by learned counsel for the petitioner are that the petitioner is a 60 year old person, in the F.I.R. nine accused persons, including the petitioner have been named and 30-35 persons have been shown as unknown and they were alleged to have assaulted the deceased on account of some land dispute but on the body of the deceased only one injury in the form of swelling of size 2"x2" below left ear has been found which falsifies the alleged assault by several persons and the I.O. found the petitioner to be innocent and, accordingly, he was not sent up but the learned Magistrate took cognizance against the petitioner also. It is further submitted that petitioner has been languishing in jail since 09.09.2024 and
Patna High Court CR. MISC. No.86328 of 2024(2) dt.13-12-2024 2/2 against him, investigation has been completed and two accused persons, namely, Sundar Kuamr @ Arbind Kumar and Kiran Devi against whom there is specific allegation in the F.I.R. have been granted bail by this court vide order dated 21.09.2022 passed in Cr. Misc. No. 35401 of 2022 and co-accused, Buletar Mandal @ Buleshar Mandal @ Buleshwar Mandal has also been granted anticipatory bail by this court vide order dated 06.09.2024 passed in Cr. Misc. No. 60746 of 2024 and the petitioner has fair and clean antecedent.
4. Learned APP appearing for the State opposes the bail prayer.
5. Considering the aforesaid submissions made by the petitioner's counsel, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner namedabove be released on bail in connection with K. Nagar (Champanagar) P.S. Case No. 81/ 2022 on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) BKS/- U T
