Petitioner, who is in custody, seeks bail in connection with Purnahiya P.S. Case No. 27 of 2017 registered for the offence punishable under Sections 366(A)/376(2) (1)/323/34 of the Indian Penal Code and Section 4 of POCSO Act.
Informant is the father of victim, who in his written complaint has stated that on 04.05.2017 at about 4.30 PM her minor daughter Madhuri Kumari had gone outside to attend the call of nature, in the meantime, his villager, Raushan Kumar (petitioner) and Janak Das forcibly took her, when she did not return and even after much search, she could not be located, thereafter one villager Amit Thakur told him that his daughter
Patna High Court CR. APP (SJ) No.4046 of 2018(6) dt.17-01-2019 2/2 was seen with Raushan Kumar at Basantpur Chawk going towards northern direction.
Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner. Accordingly this application is dismissed.
Report was called from the trial court in which it has been stated that charges have been framed against petitioner and already two witnesses on behalf of prosecution have been examined and trial is likely to be concluded soon, as such the learned 1st Additional Sessions Judge-cum-Special Judge, Sheohar is directed to conclude the trial within six months from the date of receipt/production of order passed by this Court.
