ABHISHEK REDDY ORAL ORDER 29-04-2025 Learned counsel appearing on behalf of the petitioner has stated that though the authorities have complied with the order of this Court dated 21.09.2023 passed in CWJC No. 6900 of 2023, however, the same was not done as per the time-line fixed by this Court. The authorities with a view to harass the petitioner have delayed the execution of the lease-deed by approaching the Division Bench of this Hon'ble Court by way of LPA and thereafter, on dismissal of the LPA to the Supreme Court of India. Learned counsel has stated that the lease-deed is executed for the

Patna High Court MJC No.3641 of 2023(9) dt.29-04-2025 2/2 balance period of lease i.e. calculating from the year of 2025 and not taking into consideration the time lost in litigation. Learned counsel has stated that due to the delay caused by the respondents in executing the lease-deed, the petitioner has lost almost five years, therefore, seeks adequate compensation or direct the respondents to execute the lease-deed for the balance period from the time lost in litigation.

2. The prayer sought for by the petitioner is rejected. Any time lost in pursuing the legal remedies as available to the parties cannot be a ground for extending the period of the lease. Having regard to the fact that the lease-deed is executed, the order dated 21.09.2023 passed in CWJC No. 6900 of 2023 is substantially complied with but with delay. The present contempt petition is closed. However, leaving it open to the petitioner to avail the remedies as available to him under law for compensation or for extending the lease for the period lost by way of a representation to the authority concerned.

3. With the above directions, the present contempt petition is closed.
