2. In the present case, the petitioner seeks bail in connection with Vidyapati Nagar P.S. Case No. 78 of 2025, registered for the alleged offences under Sections 191(2), 190, 329(4), 352, 115(2), 126(2), 74, 109(1), 117(2), 334(1), 329(3), 324(2) of BNS, 2023 and Section 8 of POCSO Act.
3. As per prosecution case, the petitioner and other coaccused persons assaulted the informant and her family members causing a number of injuries to them.
4. The learned counsel for the petitioner submits that the present case is completely false and concocted and has been instituted in order to create a defence against the case lodged by the petitioner vide Vidyapati Nagar P.S. Case No.76/2025. The

No.84493 of 2025(2) dt.10-12-2025 2/3 informant side is aggressor and brutally assaulted the family members of the petitioner and also damaged the vehicles kept in the house of the petitioner. Thereafter, in order to create a defence, after five days, the present case has been lodged. Moreover, there is no specific allegation of assault against the petitioner and the allegations are general, vague and omnibus. There is land dispute between the parties and Title Suit Nos.193/2013 and 198/2018 have been instituted and are still pending between the parties. The petitioner is in custody since 10.10.2025 and is having clean antecedent.
5. Learned APP vehemently opposes the submission made on behalf the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the counter version and further considering the non-specific nature of allegation against the petitioner and also considering the period of custody of the petitioner and his clean antecedent, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Samastipur/court concerned, in connection with Vidyapati Nagar P.S. Case No.
Patna High Court CR. MISC. No.84493 of 2025(2) dt.10-12-2025 3/3 78 of 2025, subject to the conditions mentioned in Section 480
(3) of BNSS and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
