JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in connection with Begusarai Town P.S. Case No. 549 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the FIR and prosecution case is that informant heard alarm of her husband and saw several accused persons caught hold of him and shot fire on his head and when he fell down other accused persons also fired and she identified the petitioner and other accused persons. Apart from that petitioner is accused in eight other cases under Section 302 IPC.

Submission of learned counsel for the petitioner is that there is no specific allegation against him and he is in custody for one year.

Patna High Court CR. MISC. No.77527 of 2019(3) dt.18-12-2019 2/2 Heard learned APP, who has opposed the prayer for bail stating that witnesses have also supported the prosecution case and he has criminal antecedents also.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.

However, since petitioner is in custody for one year learned court below is directed to expedite the commitment of the case and after commitment expedite the trial. Accordingly, this application is dismissed.
