1. Heard learned counsel for the parties concerned.

2. The petitioner has filed the present writ application for direction to the respondent-authorities to pay the due amount of Rs. 7,64,299/- against the tender issued for work for making strong room rack, painting, fire lighting in the campus of women ITI, Bhagalpur, during Assembly Constitutency Election 2020 and making barricading for vehicles, surface dressing, bathing platform, approach road and counting hall in the campus of women ITI, Bhagalpur, in Assembly Constituency Election 2020 vide

Patna High Court CWJC No.19296 of 2024(3) dt.07-11-2025 2/3 Agreement No. 18F2/20-21, 25F2/2020-21 and vide Agreement No. 26F2/2020-21 having total estimated value of Rs. 33,68,194/- (Rs. 10,97,993/-, Rs. 10,22,652/- and Rs. 12,47,549 vide letter no. 2594, dated 01.10.2020, and letter no. 3000, dated 08.10.2020).

3. Learned counsel for the petitioner submits that as per the agreement, the petitioner has performed the work allotted to him by the respondents during Assembly Election 2020. The amount of Rs. 7,64,299/- has not been paid to the petitioner and the same is sill due to be paid by the respondent.

Learned counsel for the State submits that the Executive Engineer, Building Division, Bhagalpur, vide his letter no. 2423, dated 18.06.2025, submitted a request before the Deputy Election Officer, Bhagalpur, to make the funds available to pay the petitioner's due amount of Rs. 7,64,229/-. He further submits that amount is admitted.

5. Considering the submissions advanced by the parties and the fact that amount of Rs. 7,64,299/- is admitted, accordingly, I direct the respondent-authorities to ensure the payment of Rs. 7,64,299/- to the petitioner within a period of three months from the date of receipt/production
