1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel for the petitioner submits that petitioner is an army personal, posted at Pune and could not get leave for surrendering, in compliance of the order dated 28.08.2024 in Cr. Misc. No. 61916/2024. It is next submitted that petitioner is a person with clean antecedent and is serving the country.

3. The learned counsel for the petitioner after some argument seeks permission to withdraw the modification application with liberty to file anticipatory bail application afresh.

4. Permission is accorded.
