JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-12-2018 The present writ petition has been filed for quashing the order dated 06.09.2018 passed by the General Manager, Bihar State Mining Corporation Ltd. Whereby and whereunder the petitioner Agency has been debarred from any future dealings with the Bihar State Mining Corporation Ltd. The learned Senior counsel appearing for the petitioner submits that the petitioner is ready not to deal with the Bihar State Mining Corporation Ltd., however, the petitioner be granted liberty to participate in the other tender without any prejudice being caused by the aforesaid order dated 06.09.2018. The learned counsel for the respondents submits that as far as the impugned order is concerned, the same is confined to the Bihar State Mining Corporation Ltd only.
Patna High Court CWJC No.20900 of 2018(3) dt.14-12-2018 2/2 Having regard to the rival contention raised by the parties, it is directed that the petitioner shall be at liberty to participate in other tenders barring that of Bihar State Mining Corporation Ltd. and the same shall be considered on its own merit in light of the tender conditions as also in accordance with law.
The writ petition stands disposed of with the aforesaid observations.
