2. This is the second attempt of the petitioner for grant of bail. Earlier the bail application of the petitioner was was rejected vide order dated 16.05.2023 passed in Cr. Misc. No. 6198 of 2023.

3. As per the seizure list, total 2.50 grams of brown sugar, Rs. 2,10,200/- in cash and a mobile phone have been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that alleged recovery is of intermittent quantity i.e. more than the small quantity and less than the commercial quantity. The petitioner is in custody since 01.07.2022. The petitioner

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the period of custody and the judgment of the Hon'ble Supreme Court in the case of Mohd. Muslim @ Hussain Vs. State (NCT) of Delhi reported in (2023) SCC OnLine SC 352, this application is allowed.

7. Accordingly, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, XIV, Bhagalpur in connection with NDPS Case No. 81 of 2022 (arising out of Tatarpur P.S. Case No. 137 of 2022).

8. The petitioner will co-operate in the trial and will also mark his in attendance in Kahalgaon P.S. on 1st Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner.
