The petitioner seeks bail in connection with Basmatia P.S. Case No.51 of 2025 registered for the offence under Sections 8 (c), 21 (b) of the N.D.P.S. Act. 3.

As per the prosecution case, 33 grams of brown sugar was recovered from co-accused Praveen Rai, who had confessed that the brown sugar was given to him by the petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.10.2025, and the petitioner claims that he is not involved in any other case under the N.D.P.S. Act, save and except the present one. 5.

Considering the aforesaid facts let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge

This is also subject to the condition that the petitioner, after being released on bail, is directed to mark his attendance at Basmatia Police Station, District- Araria, on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. 7.

As the petitioner claims to have clean antecedent under the N.D.P.S. Act, the Court below, before accepting the bail bonds of the petitioner, shall verify the antecedent of the petitioner under the N.D.P.S. Act. The bail bonds of the petitioner shall only be accepted by the court below if it is found that he is not involved in any other case under the N.D.P.S. Act, save and except the present case.
