2. At the very outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1.
3. Permission is accorded.
4. Accordingly, the anticipatory bail application with respect to petitioner no. 1, Shivam Kumar Singh @ Aman Singh is dismissed as withdrawn.
5. The petitioner no. 2, Chhotan Singh @ Shailendra Kumar Singh seeks bail in anticipation of his arrest in a case registered in connection with Chapra Mufassil PS Case No.
Patna High Court CR. MISC. No.3270 of 2024(2) dt.12-02-2024 2/3 510/2023 dated 28.06.2023 for the offences punishable under Sections 341, 323, 324, 325, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
6. The learned counsel for the petitioner submits that petitioner no. 2 came to be falsely implicated in the present case by the informant. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the allegation levelled is general and omnibus in nature against the petitioner. It is next submitted that allegation of assaulting the informant by Farsa on the head was against Shivam Kumar. It is also submitted that the occurrence is alleged to have taken place on account of dispute amongst the children.
7. Learned A.P.P. opposes the anticipatory bail application.
8. Considering the submissions made by the learned counsel for the petitioner, petitioner no. 2, namely, Chhotan Singh @ Shailendra Kumar Singh, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra where the
Patna High Court CR. MISC. No.3270 of 2024(2) dt.12-02-2024 3/3 case is pending in connection with Chapra Murassil PS Case No. 510/2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
9. The application stands allowed.
