JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 Petitioners pray for bail in connection with Fatehpur P.S.Case No. 335 of 2017 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. Petitioner No.1 happened to be the informant in this case and as per FIR brother of informant was found dead and later on it appears that petitioner No.1 has been made accused in this case.

Submission of learned counsel for the petitioners is that only on the basis of supervision note the petitioners have been made accused in this case and except that there is nothing against them and in case diary the witnesses have only supported the prosecution case regarding death of brother of informant and they are in custody since 6.7.2018.

Having heard both sides and in the facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Gaya, in connection with Fatehpur P.S.Case No. 335 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
