2. The petitioner is in judicial custody in connection with Mahua P.S. Case No. 129 of 2024 for the offence punishable under Sections 395 of the Indian Penal Code lodged on 16.03.2024 by the informant, Karuna Devi.
3. As per the prosecution story, the informant alleged that on the point of pistol, the accused persons took over the key of the Almirah and looted the ornaments alongwith the case. This led to the FIR.
4. Learned counsel for the petitioner submits that though he has been remanded in the present case, no TIP conducted nor there is any recovery.
5. Learned APP, Mr. Jitendra Kumar Singh on the other hand has taken this Court to paragraph-3 to show that he
Patna High Court CR. MISC. No.88094 of 2024(2) dt.03-03-2025 2/2 has 10 criminal antecedents of the same nature and further he has been remanded in this case from another case with the same section. The last submission is that similar situate Pankaj Kumar has been denied bail in Cr. Misc. No. 55274 of 2024.
6. Having gone through the facts of the case and the materials on record, the petitioner's role has come in course of investigation, he has 10 criminal cases, as stated above by learned APP, another co-accused Pankaj Kumar has been denied bail, in that background, no case of bail is made out.
7. The bail application stands rejected.
