2. The present writ petition has been preferred for the following reliefs:
The writ petition is founded on the ground that the petitioner was allotted a land by the Bihar Bhoodan Yagan Committee, subsequent to such allotment the Jamabandi was created and necessary entries were made in the Register II. The Land Revenue Receipt were issued in favour of the Petitioner. However the petitioner was
Patna High Court CWJC No.1088 of 2024(2) dt.25-04-2024 2/3 forcibly evicted from the said land allotted by the Bhoodan Committee, his application for measurement of land in question is still pending before the Circle Officer, Kuchaikote. The action of the responding authorities is thus unsustainable in law and on facts.
3. Learned counsel for the petitioner submits that he has come before this Court as the earlier application for his land measuring as contained in paragraph-5 has not been taken to its logical conclusion.
4. Learned counsel for the State Counsel submits that the said application Annexure P/7 is old one being of the year 2017.
5. Learned counsel for the petitioner submits that he shall be preferring a petition before the Circle Officer, Kuchaikote, Gopalganj (respondent no. 3) along with the requisite fee.
6. In case such, application along with the requisite fee is filed within four weeks, the respondent no.3 shall take appropriate steps for measurement of the land of the petitioner after putting all concerned to notice, fixing a date when the parties shall remain present and the land can be measured.
7. All the exercise should be completed within a period of six months from the date of receipt/production of a copy of this order.
