ANJANA MISHRA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 28-02-2019 Heard Shri Anil Kumar for the petitioner, who is the father of the victim. Shri Prabhu Narayan Sharma, learned counsel for the State has informed the Court that the victim has been recovered on 14th February, 2019 and her statement under Section 164 Cr.P.C. has been recorded. Learned counsel for the petitioner submits that she has been sent to the Remand Home. It is therefore evident that the petitioner is now aware of the whereabouts of the victim.
The petition therefore becomes infructuous and it will be open to the petitioner to seek custody or otherwise before the court concerned.
