JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 25.09.2019 in connection with Amas P.S. Case No. 183 of 2019 registered for the offences punishable under Sections 354 (A), (B) of the Indian Penal Code and 8 of POCSO Act.
The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she claimed that petitioner not only caught her hand but also dragged her with mala fide intention.
Submission on behalf of the petitioner is that the present case has been lodged on account of previous enmity and as a matter of fact, father of the petitioner being Ward
Patna High Court CR. MISC. No.77216 of 2019(2) dt.18-12-2019 2/2 Commissioner had imposed penalty on the uncle of the informant and that is why the informant has brought this false case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO Act), Gaya in connection with Amas P.S. Case No. 183 of 2019, POCSO Case No. 107 of 2019.
However, it is made clear that if any complaint of similar nature is made on behalf of the informant or others against the petitioner, then in that circumstance, the concerned court may cancel the bail bond of the petitioner after due and proper enquiry.
