2. The petitioner is apprehending his arrest in connection with Shivsagar P.S. Case No. 422 of 2024, F.I.R. dated 19.09.2024 for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 329(3), 74, 303(2), 352 and 351(2) of Bharatiya Nyaya Sanhita, 2023.

3. According to prosecution case, petitioner along with other co-accused persons has assaulted to the informant due to which she received injuries. It is further alleged that petitioner has tried to outrage the modesty of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the due to admitted land

He further submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR and the informant is cousin sister of the petitioner.

5. Learned Additional Public Prosecutor for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that it appears from the FIR that there is direct and specific allegation against the petitioner that he has assaulted to the informant and apart from that he has tried to sexually abuse the informant.

6. Considering the aforesaid facts as well as the nature of allegation in the FIR, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Shivsagar P.S. Case No. 422 of 2024 pending in the court of Chief Judicial Magistrate, Rohtas at Sasaram.

7. Prayer is refused.
