The petitioner seeks bail in a case registered for the offence punishable under Sections 272 and 273 of the the Indian Penal Code and Sections 30(a) of Bihar Prohibition and Excise and Prohibition Act,2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 37 liters of special whiskey wine has been recovered from Bolero vehicle bearing registration no.Jh-17A-4888. He further submits that the vehicle in question was not concerned with the petitioner. He further submits that the petitioner is in jail custody since 10.01.2019 and petitioner has got clean antecedent.

No.77791 of 2019(2) dt.29-11-2019 2/2 In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge Excise, Gopalganj in connection with Mirganj P.S.Case No.330 of 2018/GR No.5262 of 2018, subject to condition that the petitioner will deposit Rs.5,000/-/- (five thousand) in the civil court, Gopalganj/Nazarath, such deposit of Rs.5,000/-/- (five thousand) shall abide by the out-come of the present criminal case.
