Mr.Gulnar Begum ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 04-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

In this case, the petitioners are seeking bail in connection with Gopalpur P.S. Case No.77 of 2019, G.R. No.555 of 2019 registered for offence punishable under sections 272, 273, 240 of the Indian Penal Code and sections 30(a)/35/38 of the Bihar Prohibition and Excise Act. It has been alleged that 35.4 litres of liquor has been recovered from the bag of the petitioners. The petitioner no.1 is custody since 01.10.2019 and petitioner no. 2 is in custody since 25.09.2019.

Looking to the facts and circumstances of the case,

No.78685 of 2019(2) dt.04-12-2019 2/2 the prayer for bail of the petitioners is allowed and they are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judgecum-Special Judge Excise, Gopalganj in connection with Gopalpur P.S. Case No.77 of 2019, G.R. No.555 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in similar type of offence, the relief granted to the petitioners in the present case will be treated to have been withdrawn.
