2. The petitioner is in judicial custody in connection with Ujiarpur P.S. Case No. 60 of 2023 for the offence punishable under Section 392 of the Indian Penal Code lodged on 01.03.2023 by the informant, Surendra Kumar.

3. As per the prosecution story, the informant who is Branch Manager, Bihar Gramin Bank, Chandchaur, Samastipur alleged that as the Bank was being opened, the accused persons stormed into it and on the point of pistol looted away the entire cash (4, 37,020/-). Further, thereafter, they dragged the cash Assistant towards strong room and after getting the strong room opened, looted another Rs. 5,08,500/- totalling Rs. 9,45,520/-. The police was informed whereafter, the FIR.

4. In this case, the coordinate bench had called for the

Patna High Court CR. MISC. No.85880 of 2023(6) dt.24-10-2024 2/2 case diary and the learned APP has taken this Court to para-194 to show that not only the motorcycles, even some of the amount which was looted and the arms that was used in the crime were recovered/seized.

5. Serious allegation is against the petitioner coupled with the fact that he has seven criminal antecedents of the same nature.

6. In that background, it would be appropriate that he faces the trial. The petition stands rejected. (Rajiv Roy, J) Ravi/- U T
