141.48 litres of Indian origin foreign wine was being transported in a Bolero pickup bearing registration No. UP-79T1889 of which the petitioner happens to be driver. Further more, as is evident he disclosed that he was hired to drive the vehicle by the owner, namely, Murtuza Ansari. The petitioner is under custody since 9.9.2019 having no criminal antecedent as per disclosure made under para-3 of the petition. Consequent thereupon, the petitioner, Mustafa Khan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran, Bettiah in connection with Shikarpur P.S.Case No.

However, it is made clear that the learned lower court before acceptance of bail bond will ascertain proper identity as well as soundness of the bailor in order to have appearance of the petitioner till conclusion of the trial being resident of outside the State.
