Patna High Court CWJC No.20787 of 2018 dt.07-12-2020 2/3 Petitioner has prayed for the following relief:- "That this Public Interest Litigation (P.I.L) is being filed for issuance of an appropriate Writ(s) order(s) direction(s) for restoration ot water channel (pain) originating from the holly River Falgu and ends in Village Kazi Daulat Pur, Block Belaganj, Distt Gaya in its original form and glory which has been encroached by the local people at the village -Nandu Bigha under the Belaganj Block, District-Gaya due to which the said water channel (pain) has almost lost its character and glory and the irrigation of hundreds of acres of land of village Kazi Daulat Pur is being affected and consequently the lives of thousands of poor villagers of village Kazi Daulat Pur is on stake."
After the matter was heard for sometime, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the respondent no. 4 District Magistrate, Gaya, to consider and decide the representation with respect to grievances raised in such representation. Learned counsel for the respondent states that if such representation is filed before the respondent no. 4 District Magistrate, Gaya, same shall be considered and decided within a period of two months from the date of receipt of such representation in accordance with law.
Equally liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available
