2. The petitioner seeks bail in connection with Complaint Case bearing C.R. No. 301 of 2022 registered for the offence under Section 498A, 494/34 of the Indian Penal Code.

3. The petitioner is the husband of the victim and he is in jail since 9.8.2023.

4. Learned counsel for the informant has submitted that the petitioner has remarried and he is not maintaining his children/s.

5. Learned counsel for the petitioner undertakes to pay Rs. 4000/- per month for the maintenance of his wife and children.

6. Considering the aforesaid undertaking and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Complaint Case bearing C.R. No. 301 of 2022 subject to the condition that the petitioner will start paying Rs. 4000/- per month to his wife which shall continue during the pendency of the criminal case.

8. The aforesaid maintenance is subject to any other order passed by the Family Court concerned in an appropriate proceeding.

9. The petitioner will start paying the maintenance amount from the month of March and the bail bond of the petitioner shall be accepted by the Court below only after he pays the maintenance amount of Rs. 4000/- for the month of March, 2024 and after being released from jail the petitioner will pay the maintenance amount from the month of April, 2024 onwards which shall be paid before 15th day of each month.

10. The account number shall be provided by the victim/informant in the Court below and any failure in paying the maintenance amount will result in cancellation of bail bonds of the petitioner.
