2. The petitioner seeks bail in connection with Uchkagaon P.S. Case No. 386 of 2023 registered for the offence punishable under Sections 8, 20(b)(ii)(A) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. As per the prosecution case, 1.3 Kg. Ganja has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 21.09.2023 having clean antecedent.

5. It has been submitted by learned counsel for the petitioner that the recovery is of an intermittent quantity and

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the intermittent quantity recovered and the clean antecedent of the petitioner, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Gopalganj in connection with Uchkagaon P.S. Case No. 386 of 2023.

9. The petitioner will also mark attendance in Uchkagaon Police Station, Gopalganj on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
