JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Petitioner seeks bail in connection with POCSO Case No.31 of 2019 arising our of Rasulpur P.S. Case No. 50 of 2019 registered under Sections 376AB and 307 of the Indian Penal Code and later on Sections 4, 6, 8, 10, and 12 of POCSO Act were added.

Allegation is of sexual assault to the minor daughter of the informant who was none else but the niece of the petitioner.

Submission of learned counsel for the petitioner is that medical report does not support the sexual assault. The petitioner is uncle of the informant and he is in custody since 30.03.2019.

Heard APP and perused the impugned order. It appears that the victim who is minor has named the petitioner in

Patna High Court CR. MISC. No. 837 of 2020(5) dt.26-02-2020 2/2 her statement under Section 164 of the Cr.P.C. In view of the above, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed. (Vinod Kumar Sinha, J) SUMIT/- U T
