JUSTICE SANDEEP KUMAR ORAL ORDER 06-09-2024 Heard learned Senior Counsel for the petitioner and Mr. Jharkhandi Upadhyay, learned Additional Public Prosecutor for the State as well as learned counsel for the informant.

2. The petitioner seeks bail in connection with Laheriasarai P.S. Case No. 487/2023 registered for the offence punishable under Sections 363/365/34/364/302/201/120(B) of the Indian Penal Code.

3. As per the prosecution case, the deceased was cut into pieces. One Sanjeet Kumar is said to have given the contract for the killing of the deceased.

4. Learned Senior Counsel for the petitioner submits that the petitioner is the driver of the Scorpio vehicle which was taken on hire by the accused persons who took the deceased on the vehicle. During investigation, it has come that the petitioner

Patna High Court CR. MISC. No.6567 of 2024(3) dt.06-09-2024 2/2 dropped the deceased and the accused persons in a temple on the Kosi Bandh (Dam) and thereafter left. Subsequently, in the morning while sleeping in the vehicle, he was again contacted by the two accused who had earlier killed the deceased. The killing of the deceased was not in the knowledge of the petitioner. Before police he has identified the co-accused and has said that there was one more person with long hairs. The petitioner is in custody since 23.10.2023.

Considering the fact that the petitioner is the driver of the Scorpio vehicle which was taken on hire by the accused persons and there is no involvement of the petitioner in the crime, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/concerned court in connection with Laheriasarai P.S. Case No. 487/2023.
