2. In the present case, the petitioners seek bail in connection with Samastipur(Muffasil) P.S. Case No.350 of 2025, registered for the offences under Sections 126(2), 115(2), 303(2), 109(1), 351(2) and 3(5) of the BNS.
3. As per the prosecution case, petitioners and other co-accused persons surrounded the informant while he had been returning home on his motorcycle and they were armed with hockey sticks, knife and pistol. They demanded money from the informant on gunpoint and co-accused hit the informant on his head by the butt of the pistol. The petitioner Sunny Kumar gave a blow of hockey stick on the forehead of the informant and petitioner Manoj Rai snatched Rs.36,000/- from the informant.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Learned counsel further submits that the petitioners and informant are in the business of purchase of sand and some altercation took place between them. The informant is an agent of owner of truck and purchaser of sand and some dispute arose between truck owner and informant due to which a scuffle took place between them and for this reason due to previous enmity these petitioners have been implicated in this case. Injury report shows the injury is simple in nature though it was caused on the head of the informant. There has been compromise between the parties and a compromise petition has been filed before the learned trial court on 11.11.2025. The petitioner no. 1 is in custody since 31.08.2025 and petitioner no. 2 is in custody since 06.09.2025. The petitioner no. 1 is having antecedent of four cases and petitioner no. 2 is having antecedent of one case. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the

No.85143 of 2025(2) dt.10-12-2025 3/3 period of custody of the petitioners and submission of charge sheet against them, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Samastipur/concerned court, in connection with Samastipur(Muffasil) P.S. Case No.350 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
