JUSTICE VIKASH JAIN ORAL ORDER 22-02-2019 Learned counsel for the petitioners states that the petitioner no. 2 has been arrested and as such the anticipatory bail petition of petitioner no. 2 has become infructuous and seeks permission to withdraw the same.
2. The anticipatory bail petition of petitioner no. 2 stands dismissed as withdrawn.
3. The petitioner nos. 1 and 3 apprehend their arrest for the offences alleged under Sections 307, 323, 341, 342, 504, 506, 379/34 of the Indian Penal Code registered in connection with Karakat P.S. Case No. 142 of 2016.
4. It is submitted that the petitioner nos. 1 and 3 have been falsely implicated and as a matter of fact it was a fight
Patna High Court Cr.Misc. No.64982 of 2018(3) dt.22-02-2019 2/2 between the villagers and the teachers of the school. It is submitted that none of the students have recorded the statement before the police to support the prosecution case and the accusation of assault is general and omnibus in nature.
5. Learned APP on the basis of case diary opposes the anticipatory bail petition, submitting that the petitioners are accused of taking photographs of the photos of the girls pasted on the notice board. It is submitted that assault has been made on several teachers including lady teacher who has received a number of injuries.
6. Having regard to the nature of accusations and the gravity of the offence alleged, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner nos. 1 and 3. The anticipatory bail petition of petitioner nos. 1 and 3 stands dismissed.
