2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103 ( 2 ) and 61 ( 2 ) of BNS and 27 of Arms Act.
3 . The case of the prosecution , in short, is that, informant namely , Aarti Kumari alleged that on 21.01.2025 , her husband was going to village and after some time, informant got information that her husband has been shot dead. It is further alleged that all the F.I.R. named accused persons conspired with
Patna High Court CR. MISC. No.86438 of 2025(2) dt.17-12-2025 2/3 each other and committed murder of her husband to grab his land.
4. Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation on the basis of CCTv footage wherein this petitioner was seen fleeing away from the place of occurrence . Informant is not an eye witness to the alleged occurrence. Only vague suspicion has been raised against this petitioner and he has got no concern with the alleged occurrence . Petitioner is in custody since 25.04.2025 . Similarly situated co-accused person has already been granted bail by this Hon'ble Court vide order dated 27.11.2025 in Cr. Misc. No. 81189 of 2025 .
5 . Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Considering the aforesaid facts, materials available on record, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with GRP/Kiul P. S. Case No.
