The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

As per the allegation in the FIR, total 91.5 litres of liquor including 18 litres of Nepali liquor is said to have been recovered from the sack thrown by the petitioner and one another person.

It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R is false and concocted, he is in custody since 16.10.2019 having no criminal antecedent and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 16.10.2019, has no criminal antecedent and charge sheet has been submitted in the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge under Excise Act, East Champaran at Motihari in connection with Raxaul P.S. Case No. 385 of 2019.
