By way of present modification application, the petitioner seeks to modify the order dated 06.08.2018, by which, the application of the petitioner for grant of anticipatory bail was disposed of with certain observation and direction. Submission of learned counsel for the petitioner that due to illness, he could not surrender within the time prescribed by this court. Further submission is that the petitioner is ready to abide by all the terms and conditions mentioned in the order dated 06.08.2018.

Having heard both sides, considering the facts and circumstances of the case, a further period of four weeks is allowed to the petitioner to surrender before the court below along

Patna High Court Cr.Misc. No.64305 of 2018 (2) dt.31-10-2018 with a Bank Draft of Rs.3 lakhs payable to the opposite party No.2, he will be released on provisional bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Complaint Case No. 623 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. Further he will pay the remaining amount in the next following month and on depositing the total amount his bail bond shall be confirmed and the amount would be released in favour of opposite party No.2, which will be subject to the result of the case.

With the above observation, the modification application stands allowed.
