The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 323/324/502 of the Indian Penal Code.

Prosecution case is that present case instituted on the written information of Satendra Singh wherein he started that he has given land by S.D.J.M., Piro of Rs. 4 lacs and had sown Khesari and Masur and on 09.03.2019 petitioners and others were harvesting the crops of informant. Further stated that he went in his land then he saw in torch light that petitioners carrying his crops.

No.86544 of 2019(2) dt.17-02-2020 2/2 Learned counsel for the petitioners submits that no occurrence took place as alleged rather the petitioners are land owner of the disputed land. They have purchased land Khata No. 177 by Baleshwar Singh and Khata No. 218 by Prakash Narayan Singh and Tej Narayan Singh. Further submits that during investigation witnesses said that no Masur and Kheshari crops was harvested in the field and this case was lodged with some ulterior motive on false allegation.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No. 12 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
